Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Binary Diaries Indicator/expert advisor for the MetaTrader 4 (“MT4”) platform and the associated website, services, and software (collectively the “Product”). By downloading, installing, accessing, or otherwise using the Product, you agree to be bound by these Terms. If you do not agree to all of the Terms, you may not use the Product.

All Sales are Final, There are no Refunds.

1. License and Restrictions 1.1 Subject to your compliance with these Terms, the owner (“Owner”) grants you a limited, non-exclusive, non-transferable, perpetual license to download, install and use the Indicator solely for your personal, non-commercial use.
   1.2 You may use the Product only on one MetaTrader 4 account that you own and control. Use on additional MT4 accounts requires separate licenses. 1.3 You may not copy, reproduce, modify, disassemble, decompile or reverse engineer the Product or create derivative works based on it. 1.4 You may not rent, lease, distribute, sell, sublicense or otherwise transfer the Product to any third parties. 1.5 Your license is for personal use only. Any commercial, institutional, educational or organizational use requires express written permission and separate licensing.
2. Ownership 2.1 The Product, including but not limited to the Indicator software, code, documents, data and all other components are the sole and exclusive property of the Owner. 2.2 The Product is licensed to you, not sold. The Owner retains all rights, title and interest in the intellectual property rights related to the Product. 2.3 No title or ownership of the Product or its source code is transferred to you under these Terms. All use must be in accordance with the license granted.
3. Disclaimer of Warranties 3.1 The Product is provided to you “as is” and “as available” without warranty of any kind, whether express, implied or statutory. 3.2 The Owner disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and title. 3.3 The Owner does not warrant that the Product will meet your requirements, function without interruption or be error-free, secure or virus-free.
   3.4 Your use of the Product is solely at your own risk. The Owner shall have no liability for data loss related to your use of the Product.
4. Limitation of Liability
   4.1 In no event shall the Owner be liable for any damages of any kind arising from the use of or inability to use the Product, including direct, indirect, incidental, special, consequential or punitive damages. 4.2 This limitation applies regardless of whether the damages were foreseeable and whether the Owner was advised of the possibility of such damages. This includes damages for loss of data, profits, business interruption, computer failure/malfunction, trading losses or any other pecuniary loss. 4.3 The Owner’s cumulative liability to you for direct damages from all causes of action related to the Product shall not exceed the amount, if any, paid by you for the Product. 4.4 Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above exclusions and limitations may not fully apply.
5. Indemnification 5.1 You agree to indemnify, defend and hold the Owner and its related companies harmless from any claims, losses, liabilities, damages, costs and expenses (including attorneys’ fees) arising from your use of the Product, violation of these Terms, or other acts or omissions that result in liability to the Owner.
6. Termination
   6.1 These Terms will remain effective until terminated by either party. Your rights will terminate automatically without notice if you fail to comply with any provision of these Terms. 6.2 Upon termination, you must immediately cease using the Product and destroy all copies in your possession or control.
7. General Terms 7.1 These Terms constitute the entire agreement between you and the Owner regarding your use of the Product, superseding all prior agreements. 7.2 These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction] without regard to its conflicts of law principles.
   7.3 If any provision of these Terms is found invalid or unenforceable, that provision will be severed and the remainder shall continue in full force. 7.4 The Owner may update these Terms periodically without specific notice. Your continued use constitutes acceptance of those changes. 7.5 The Owner’s failure to exercise or enforce any right or provision of these Terms shall not waive its right to enforce such rights or provisions in the future. 7.6 The section titles in these Terms are for convenience only and have no legal or contractual effect.
8. No Refund Policy 8.1 The BD Indicator is a non-refundable purchase. The Owner operates under a strict no refund policy for all sales of the Product.8.2 By purchasing a license for the BD Indicator, you acknowledge and agree that you are making a one-time payment for a perpetual software license. No refunds will be issued for any reason after your purchase is complete.8.3 The no refund policy applies at all times, without any exceptions. This includes but is not limited to cases of dissatisfaction with the Product, if you misunderstand the Product’s features or capabilities, or if you simply change your mind after completing the purchase. 8.5 If you have any questions or need clarification on the Product’s functionality, capabilities or appropriate usage, you are advised to contact our support team prior to purchase. We cannot process any refund requests after your payment is completed. 8.6 By agreeing to these Terms and completing your purchase, you confirm that you understand and consent to this no refund policy in its entirety. All sales are final with no refunds permitted.
